&lt;p&gt;The political Right is up in arms, equating “hate crime” with “thought crime”… and I have to say, I agree.&lt;/p&gt;
&lt;p&gt;A crime is a crime.  The &lt;i&gt;why&lt;/i&gt; shouldn’t matter, at least in terms of the law and possible punishment.  The &lt;i&gt;why&lt;/i&gt; might be reprehensible, might be ugly and offensive, ignorant and bigoted and evil and repulsive… but I don’t understand punishing a wicked motivation at a different level than one that is merely immature or naiive.&lt;/p&gt;
&lt;p&gt;We already (correctly, in my view) make a distinction between crimes of intent and crimes of negligence… why do we need harsher punishments for someone who kills a clown (to use an obviously silly example) &lt;i&gt;because&lt;/i&gt; he hates clowns?&lt;/p&gt;
&lt;p&gt;Am I missing something?  As always, I’m open to genuine dialogue and any facts I may be missing or haven’t considered.&lt;/p&gt;

&lt;p&gt;I would argue that hate crimes should be punished more harshly because they are “message crimes.” If someone kills a clown because he hates clowns, the killer is telling not only the victim but also the entire clown community that clowns deserve to die.
